Todd R. Walters Helps to Secure Victory for Client Abbott GmbH

Todd R. Walters, shareholder in Buchanan’s Intellectual Property section, and James Ferguson of Mayer Brown LLP represented client, Abbott GmbH in a protein patent dispute against Yeda Research and Development Co. Ltd. The dispute “began in 1996 to determine whether Abbott or Yeda was the first to invent the claimed protein, which was used in autoimmune therapies.”

“The Federal Circuit rejected Yeda’s argument that there was not enough evidence to support the decisions by the court and the Patent Trial and Appeal Board that Abbott’s patent was entitled to a priority date that meant it was not invalid as anticipated.”
