The Dunham Rule Lives! The PA Supreme Court's Ruling in Butler v. Powers and its Effect

Greg J. Krock conducted a well-attended seminar for the Pennsylvania Bar Institute entitled The Dunham Rule Lives! The presentation involved the firm's successful appeal to the Pennsylvania Supreme Court in the high-profile oil and gas case of Butler v. Charles Powers Estate.
Krock set forth the basis for the Court's unanimous opinion in late April 2013 preserving the "Dunham Rule" which requires that, for an interest in natural gas rights to be reserved in a deed, the term "natural gas" must be specified within the reservation. Purpura addressed the ruling's practical effect in conducting due diligence for transactions involving the purchase and sale of Marcellus Shale acreage in Pennsylvania.
