John Warner of Buchanan Ingersoll & Rooney PC told Law360 Monday that the Senate minimum tax “avoids a lot of the international political issues” because it is in the form of a minimum tax on U.S. taxpayers and not an excise tax on those taxpayers — or an income tax on foreign taxpayers that don’t have sufficient tax nexus under accepted international tax rules to be subject to U.S. tax.
