NetDiligence - U.S. Department of Justice’s View on Best Practices in Cybersecurity

Adam Saltzman, Counsel in the firm's Litigation section, will participate on a panel "U.S. Department of Justice’s View on Best Practices in Cybersecurity," hosted by NetDiligence, on June 14 from 10:30 to 11:30 a.m. The panelists, who each have experience with the federal government, will discuss the Department of Justice’s latest suggestions on how to effectively interface with law enforcement during and after an incident. Panelists from the private sector will give their real-world perspective on how it has and has not been effective, as well what has driven their decision to engage or not engage with law enforcement.

In September 2018, the U.S. Department of Justice updated its guidance to companies on how to effectively plan and respond to a cyber incident, incorporating lessons learned by federal investigators and prosecutors, with input from private sector companies. This panel will offer the most up-to-date guidance from the federal government to protect your cyber assets, offering perspectives from within the government, lawyers with prosecutorial experience, and a forensic firm.

The panel will discuss:

• The Department of Justice’s suggestions on how to best prepare for a cyber incident, including addressing the recent dramatic increase in ransomware attacks and related trends
• The government's roadmap of do’s and don’ts: from how a company can manage its network to legally monitor network traffic, to how a company can step over the line and get into trouble when trying to protect its assets by, for example, “hacking back” or taking retaliatory action
• How working with the government in the event of a cyber incident can be effective
