John P. Warner Quoted in Bloomberg BNA Article on Boston Scientific Corporation’s Transfer Pricing Settlement

John P. Warner, shareholder in Buchanan’s tax section, was quoted in a Bloomberg BNA tax report titled, “Boston Scientific Settles ‘Guidant’ Tax Cases, Will Pay $275M,” regarding a transfer pricing dispute between medical device maker Boston Scientific Corporation and the IRS.

“That is significantly higher than what the estimated 3 cents on the dollar or so that the IRS got from the Tax Court for the two years that were litigated in Medtronic,” Warner said in an e-mail. “But it is also possible that, if IRS Appeals settles the 2008-2010 years on a similar basis—which certainly seems to be contemplated—that 28% (or 26%) figure could come down a bit more.”
