Patrick Keane, Executive Shareholder in Buchanan's Intellectual Property section, will serve as a panelist on a webcast that will discuss the ramifications of the Federal Circuit’s en banc decision in Aqua Products, Inc. v. Matal. In Aqua Products, the Federal Circuit held that the PTAB improperly places the burden of persuasion on patent owners for motions to amend presented in an inter partes review (IPR), which was the PTAB’s policy for the first five years of IPR trials. The Federal Circuit was divided, however, on whether the statutory provision defining the burden of persuasion in IPR trials applies to motions to amend, and whether the Patent Office would be entitled to deference if it enacted rules defining the burden of persuasion for motions to amend.
