McLaughlin, shareholder in the labor and employment group at Buchanan Ingersoll & Rooney PC in Pittsburgh, reminds you that in these cases employers must engage in what's known as an interactive process to determine whether the accommodation required to keep the employee presents an undue hardship to the organization (PBN 2/22/21).
"If an employee has an exemption request pending, my recommendation has been to provisionally grant the request and, if the employer has been granting accommodations, accommodate the employee consistent with other employees who have been granted an exemption," McLaughlin says.
