Buchanan Team Sinks Complaint Against Client Personal Water Craft

Buchanan Ingersoll & Rooney Shareholder Philip Hirschhorn obtained dismissal for firm client Personal Water Craft of a third party complaint by its U.S. distributor claiming fraud and breach of indemnification provisions of the distribution agreement covering the “Flyboard.”

In a tight turnaround, the team with the assistance of Buchanan attorney Rick Morgan and legal assistant Michelle Pelaez argued that the claims all “arose from” the agreement and had to be brought in the chosen forum – the Commercial Court of Marseille. The Court in this action pending in the Southern District of Florida agreed and dismissed Personal Water Craft and its owner, former world jet ski champion Franky Zapata, from the action on the eve of trial.
