Buchanan Obtains Win for Hamilton Technologies LLC at the U.S. Court of Appeals for the Federal Circuit, Clearing a Legal Hurdle for Hamilton’s INTELLiVENT-ASV® Ventilator Products
WASHINGTON (July 2023) - Buchanan obtained a favorable decision on June 28, 2023 from the U.S. Court of Appeals for the Federal Circuit (CAFC) on behalf of Hamilton Technologies LLC, affirming a 2021 decision by the U.S. Patent and Trademark Office Patent Trial and Appeal Board.
Hamilton Technologies’ favorable decision from the CAFC clears a hurdle with regard to Hamilton’s roll out of its innovative INTELLiVENT-ASV® ventilator product line.
The case stems from global assertions of patent infringement by Dr. Fleur Tehrani. The CAFC ultimately held challenged claims of the asserted patent to be invalid, clearing a pathway for Hamilton to proceed with pending FDA approval of its INTELLiVENT-ASV® product line.
The CAFC’s decision aligns with a favorable decision for Hamilton before the United Kingdom’s Intellectual Property Enterprise Court (IPEC) in 2022.
