A team of litigators from the firm’s Philadelphia and New York offices recently obtained the complete dismissal of numerous claims, including breach of contract and deceptive business practices, against two of the firm’s lending clients. The claims, which were originally filed in state court in Manhattan, arose from the alleged miscalculation and misreporting of the plaintiff’s student loan debts. After removing the case to the Southern District of New York, the Buchanan team engaged in a proactive program of voluntary and expedited discovery designed to convince the plaintiff not only that our clients had no involvement in any such errors, but also that his Complaint as filed against them was dangerously without basis. As a result, the plaintiff agreed to withdraw all claims against our clients with prejudice before the start of formal discovery, leaving three other lenders and loan servicers remaining as defendants in the case.
