Shareholder Michael Truncellito, along with associate John Lamb, earn back-to-back summary judgment wins on behalf of separate employers in the Eastern District and Western District of PA.

On December 10, 2024, following a robust oral argument, the Honorable John R. Padova granted Michael Truncellito’s motion for summary judgment on behalf of his client employer, putting an end to a hotly contested age discrimination claim. In his memorandum opinion, Judge Padova held that the employer’s stated reasons for termination were supported by the record evidence and that the plaintiff could not establish pretext.

This marks Michael Truncellito and John Lamb’s second summary judgment win on behalf of an employer in the last 3 weeks – both involving claims of age discrimination. It also comes on the heels of Michael Truncellito’s successful defense of a jury verdict that he and fellow shareholder Charlene Gedeus recently obtained for another employer following a grueling two-week trial. During oral argument before the Superior Court following the plaintiff employee’s appeal, Michael Truncellito successfully prevailed upon the three-judge panel to uphold the jury verdict in favor of the employer.
