Jonathan Bowser, Counsel in Buchanan’s Intellectual Property section, presented “Recent Developments in AIA Estoppel” at the AIPLA’s Mid-Winter Meeting in Ft. Lauderdale, FL. Jonathan’s presentation discussed how the U.S. Court of Appeals for the Federal Circuit, district courts and the Patent Trial and Appeal Board (PTAB) had interpreted the scope of estoppel from inter partes review (IPR) trials before the PTAB. IPRs were created by the America Invents Act (AIA) of 2011 to serve as a relatively expedient, cost-effective option for contesting the validity of granted patent claims.
