NLRB Posting Requirements Extended
Employers subject to the jurisdiction of the National Labor Relations Board (which is most private sector employers whether unionized or not) now have until April 30, 2012 to post the required notice of rights under the National Labor Relations Act. Information we received indicates that the NLRB postponed implementation of the controversial posting rule from January 31, 2012 until April 30, 2012 because of a request made by the presiding judge of the United States District Court for the District of Columbia in connection with the lawsuits brought by the National Association of Manufacturers and the National Right to Work Legal Defense and Education Foundation. There could be more delays of this politically volatile and litigation-breeding agency requirement.
