- C.M. v. C.C.
October 2008
The parties, a same sex couple, were married in Massachusetts in a civil ceremony on August 26, 2005. At the time of their marriage, they were residents of New York. ... Earlier this year, the parties filed for divorce in this Court and an inquest on grounds was held. Although there was no opposition to the holding of the inquest, a question arose as to whether this Court had jurisdiction to grant a divorce to the parties since they could not, as a same sex couple at the time of their marriage or now, get married in New York State.
