  • International Trade Representative Matters

    • Candles from China: represented a national candle association as petitioner in an antidumping investigation, a new shipper investigation, 6 administrative reviews, over 400 scope reviews, 2 anticircumvention reviews, 4 sunset reviews, 6 customs investigations, and appeals to the U.S. Court of International Trade and to the U.S. Court of Appeals for the Federal Circuit – resulted in a continuous 108% duty and CDSOA distributions of $183 million to U.S. candle companies.  The original antidumping duty was 56% and, with each administrative review, increased to the 108% level where it remains.

    • Headware from China: represented U.S. manufacturers of baseball hats, as petitioners in antidumping investigation.

    • Sparklers from China: represented U.S. sparkler manufacturers as petitioner in an antidumping investigation resulting in an affirmative determination.

    • Emulsion Styrene-Butadiene Rubber from Korea: represented a coalition of importers, resulting in a negative injury determination.

    • Outboard Engines from Japan: represented importer resulting in a negative injury determination.

    • Thermostatically Controlled Appliance Plugs from Canada: represented Canadian producer resulting in a negative injury determination.

    • Softwood Lumber from Canada: represented Quebec lumber manufacturers in the Binational Panel review of the countervailing duty investigation in the 1990s, resulting in a settlement between the U.S. and Canadian governments.

    • Softwood Lumber from Canada: represented Canadian lumber remanufacturers in the Binational Panel review of the countervailing duty investigation in the 2000s, resulting in a settlement by the U.S. and Canadian governments.

    • Tillage Tools from Brazil: represented a Brazilian producer resulting in termination of the countervailing duty order.

    • Wheat Gluten: represented U.S. producers in a §201 market disruption/safeguards investigation resulting in a 3-year quota and a subsequent grant from the Department of Agriculture of $40 million.

    • Ceramic Packages from Japan: represented multi-billion dollar corporation in a §232 investigation by the U.S. Commerce Department of the impact of the imports on U.S. national security, resulting in no restrictions on the client’s exports to the U.S.

    • Saccharin from Korea: represented U.S. producers in Generalized System of Preferences investigations resulting in withdrawal of GSP duty-free treatment of the imports from Korea

    • Glassware from Mexico: represented U.S. producer in Generalized System of Preferences investigations resulting in withdrawal of GSP duty-free treatment of imports from Mexico.

    • Represented U.S. glassware manufacturer in the NAFTA and Uruguay Round multilateral trade negotiations.

    • Advised American gear manufacturers and European associations on international standards process in order to avoid trade barriers.

    • Export of chemicals to Mexico: represented exporter in US Customs investigation of Export Control violation.

    • Export of missile fuel equipment to Taiwan: represented US exporter in acquiring the necessary export license for high technology equipment.

    • Export of medical supplies and equipment to a country subject to US sanctions: represented manufacturer in acquiring the necessary export license.

    • Exclusion of foreign exporter from application of US sanctions: represented foreign manufacturer in excluding its products from US sanctions, thereby allowing export to the US.

    • Dual use equipment export controls: represented three trade associations in negotiations leading to narrowing the scope of dual use export controls over process equipment.

    • Motorcycle pedals from China: represented U.S. importer in Customs seizure based on alleged trademark infringement/counterfeit goods resulting in a ruling in favor of the imports.  Provided policy and regulatory consulting, in addition to government inquiries and legal representation.

  • Trade Association Representative Matters

    • Coffins and hospital beds from China:  consulted with and advised U.S. producer regarding Chinese infringement of U.S. patents, including regulatory investigation and interpretation.

    • Advised clients on the requirements, potential impacts and strategies for “Buy America” legislation.

    • Advised associations on standards process in order to avoid restraint of trade issues.

    • Challenged standards of a national fire protection association on 2 separate matters, successfully resulting in the association withdrawing the standards, returning them to committee, and adding representatives of client association to its committee.

    • Challenged proposed standards (Teflon coated rebar and mud flaps for trucks) at Federal Highway Administration and National Highway Safety Administration that would exclude products of 2 different associations, successfully resulting in withdrawal of proposed standards.

    • In an antitrust investigation, succeeded in keeping an association out of the proceeding in which some members were convicted.

    • Guided an association and foundation through criminal and civil issues arising out of embezzlement by staff.

    • Negotiated the merger of two competing associations and their trade shows.

    • Represented associations on issues before Congress and Executive departments and agencies, and prepared testimony for members to present to Congress.

    • Challenged trademark infringement of associations’ names and logos.

    • Advised regarding age discrimination claims, and termination of staff and Executive Director.

    • Represented in trade remedy investigations for unfair competition from imports, resulting in antidumping and countervailing duties and quotas.

    • Advised tax issues relating to royalty/endorsement agreements, unrelated income, and 501(c)(3) restrictions.

    • Negotiated and drafted agreement for sale of association magazine.

    • Resolved retirement benefits disputes.

    • Represented associations in establishment of domestic and international standards.
